Attorney Adam Nemann argues case and passionately defends client before Franklin County Court of Common Pleas. 

Brian K. Smith, 26, had chosen to not have a jury hear his case, instead asking Judge Kim Brown to decide whether his actions that led to the death of Rodney Brown, 46, were justified.  

Smith had argued he shot Brown in self defense during an argument on Stornaway Drive South.

Brown was found fatally shot around 7:30 p.m. Sept. 11, 2021, on a sidewalk behind a home on the 6100 block of the Southeast Side street.  

Judge Brown determined after hearing testimony over a two day period that the fatal shooting qualified as self-defense under Ohio law.

Smith, who had been released on a $30,000 bond in the case after being held in custody for more than a year, was officially released from custody and supervision following the judge's decision.
